WHAT ARE THE REGULATIONS CONCERNING WASTE TRANSPORT SINCE 2018?

It is necessary to be registered for waste transport (section VII).

Why?

Because waste transport authorisations, issued on the basis of the old act of 27 April 2001 on waste, maintain their validity only for the period they were issued for, but not longer than until the deadline for application for registration into the waste database (BDO) – that is till 24 July 2018 or till the date of getting entry into the register, if this entry occurred before the aforementioned deadline expiration. After being registered into the waste database (BDO), an entity is allowed to transport only the waste indicated in section VII of the entry. However, the waste transport authorisation, that an entity got earlier, expires.

Waste transport rules

The rules that are applied to waste transport are set out in the Regulation of the Minister of Environment of 7 October 2016 on detailed requirements for waste transport and have been applicable since 24 January this year.

The most important of them are:

1. The obligation for fitting marking on the vehicle transporting waste in a visible place, located on the front.
2. The obligation to have a document confirming the waste type being transported *waste transfer note / waste sales invoice / basic characterisation of waste / notification document for transboundary movements/shipments of waste.
